Legionella Risk Assessment

Landlords of residential accommodation have responsibilities for combating Legionnaires’ Disease. Health and safety legislation requires that landlords carry out risk assessments for the Legionella bacteria which cause Legionnaires’ Disease and thereafter maintain control measures to minimise the risk. Most rented premises will be low risk but it is important that risk assessments are carried out and control measures introduced.

What is Legionella?

Water Systems in the household is perfect breeding ground for Legionnaires’ disease. Legionnaire’s is a form of pneumonia caused by the inhalation of small droplets of contaminated water containing Legionella. Any water system both hot and cold can provide the perfect conditions for the disease to flourish.

What is the Law?

As a Landlord or even if you rent a room out in your own home it’s your legal responsibility to ensure that your tenants can live in your property with no undue effect on their health and safety and ensure that they are free from any health hazards.
This is enshrined under law, through the legislature of Section 3(2) of the Health and Safety at Work Act 1974.
Landlords, under Section 53 of HSWA are regarded as being self-employed and tenants fall into the class of “other persons (not being his employees)”. If you rent out a property, you have a legal responsibility to ensure your tenants live in a property that is free from hazards and your tenants are safe and healthy.
